Purpose

 

Modifies procedure for lapsing a common school district.

 

Background

 

Statute allows a county school superintendent to suspend a common school district that, for three months during the school year, has a student count of less than eight pupils between the ages of 6 and 21. The Board of Supervisors (BOS) may declare the common school district lapsed and attach the territory to one or more adjoining school districts, dispose of the lapsed common school district's property and apply the proceeds to the credit of the lapsed common school district (A.R.S. § 15-469).

 

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.      Removes the authority of a county school superintendent to suspend a common school district that has, for three months of the school year, a student count of less than eight pupils.

 

2.      Requires, if a common school district has a student count of less than eight pupils for two consecutive years, the county school superintendent to notify the common school district and the BOS.

 

3.      Requires the BOS to provide the common school district additional time to recruit more pupils and allows the BOS to declare the school district lapsed if, at the end of the additional time provided, the student count is less than eight pupils.

 

4.      Becomes effective on the general effective date.
