satellite television; contracts; renewal; notice

 

Purpose

 

Requires a satellite television service provider to notify a customer in writing at least 30 days before a service contract automatically renews.

 

Background

 

Statute establishes unique regulations for some industry-specific contracts, including household goods movers, health spas and dating referral services (A.R.S. §§ 44-1611, 44‑1791 and 44-7151). Under current law, a property management agreement may contain an automatic renewal provision if the management firm sends the property owner a reminder notice at least 30 days before the renewal date (A.R.S. § 32-2173).

 

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.      Requires a satellite television service provider (provider) to notify a customer in writing at least 30 days before a service contract automatically renews without customer action.

 

2.      Allows a customer to prevent a contract's automatic renewal by notifying the provider at any time before the date of renewal.

 

3.      Requires the written notice to clearly state the contract expiration date and that the contract automatically renews unless the customer notifies the provider not to renew the contract.

 

4.      Becomes effective on the general effective date.
