juror questionnaire; investigations

 

Purpose

 

Allows a county attorney to assist in the investigation of responses to a juror questionnaire.

 

Background

 

To serve as a juror in Arizona, a person must: 1) be at least 18 years old and a United States citizen; 2) be a resident of the jurisdiction in which the person has been summoned to serve; 3) not have been convicted of a felony unless the person's civil rights have been restored; and 4) not have been determined by a court to be mentally incompetent or insane (A.R.S. § 21-201).  

 

Prospective jurors are mailed a jury summons and a juror affidavit questionnaire prior to their service date. The completed questionnaires are returned to the jury commissioner or manager to determine whether a person is qualified to serve or has valid grounds to be excused or postponed from service. The jury commissioner or manager may further investigate the accuracy of each prospective juror’s questionnaire answers by requesting the assistance of law enforcement. Juror questionnaires may be destroyed 90 days after they have been received by the jury manager or commissioner (A.R.S. § 21-314).

 

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1. Allows a county attorney to assist in the investigation of responses to a juror questionnaire.

 

2. Becomes effective on the general effective date.
