Purpose
Limits public records inspection of a Public Safety Personnel Retirement System's (PSPRS) member information.
Background
PSPRS is a special retirement system created by the Legislature for certain full-time certified peace officers and full-time firefighters in the state of Arizona. PSPRS is designed to meet the special needs of personnel engaged in hazardous duty situations.
PSPRS is a governmental retirement plan qualified under 401(a) of the Internal Revenue Code. Separate accounts are kept for each employer in the system. Monies in the entire system are pooled for investment purposes, but benefits and refunds are paid for by each employer only from the employer's separate account in the PSPRS. A defined contribution plan has been established for PSPRS members hired on or after July 1, 2017.
Similar legislation was enacted for the Arizona State Retirement System in 2013 (Laws 2013, Chapter 110).
There is no anticipated impact to the state General Fund associated with passage of this resolution.
Provisions
1. Limits public records inspection of a PSPRS member's information, to protect a member from fraud, abuse, theft or civil or criminal activity, to the following:
a) the member's name;
b) whether the member is an active member, an inactive member or a retired member;
c) the member's current or most recent employer;
d) for a retired member, the average monthly compensation used to calculate the member's retirement benefit;
e) the credited service on account for an active or inactive member or the credited service used to calculate the member's benefit;
f) the gross pension amount paid to a retired member;
g) the most recent retirement date;
h) the current account balance for an active or inactive member;
i) the gross long-term disability program benefits paid to a member with a disability;
j) the amount paid to purchase credited service; and
k) the amount of credited service purchased.
2. Prohibits the PSPRS Board and the administrator from allowing any unredacted record to be inspected that contains a member's Social Security number, bank account information, address, telephone number, e-mail address, medical records, health insurance information, beneficiary or survivor information, disability information or any information that is protected by any federal or state law.
3. Becomes effective on the general effective date.
