civil rights advisory board; continuation

 

Purpose

 

Continues the Arizona Civil Rights Advisory Board (ACRAB) for eight years.

 

Background

 

ACRAB was created in 1965 to assist the Civil Rights Division of the Department of Law (Division) in protecting civil rights of Arizona citizens. ACRAB assists the Division in: a) making recommendations on proposed civil rights procedural rules and holding hearings on civil rights issues; b) making periodic surveys of the existence and effect of discrimination; c) fostering through community effort, the elimination of discrimination; and d) issuing publications of research and study results (A.R.S. § 41-1402).

 

ACRAB is composed of seven members appointed by the Governor, with not more than four of the members from the same political party. Each member serves for a three-year term (A.R.S § 41-1401).

 

ACRAB is scheduled to terminate on July 1, 2018 unless legislation is enacted for its continuation (A.R.S § 41-3018.11). The Senate Judiciary and House Judiciary and Public Safety Committee of Reference held one public hearing on Tuesday, November 28, 2017, to review ACRAB's response to the sunset factors as required by statute, and to receive public testimony (A.R.S § 41-2954). The Committee of Reference recommended ACRAB be continued for eight years until July 1, 2026.

 

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.      Continues, retroactive to July 1, 2018, ACRAB until July 1, 2026.

 

2.      Repeals ACRAB on January 1, 2026.

 

3.      Becomes effective on the general effective date, with retroactive provision as noted.
