Purpose
Allows, rather than requires, a local education agency (LEA) to stock epinephrine auto‑injectors.
Background
If sufficient monies are appropriated, each school district and charter school is required to stock two juvenile doses and two adult doses of epinephrine auto-injectors. The Arizona Department of Education (ADE) is required to include in its annual budget request a line-item for a continuous, non-lapsing appropriation for each LEA to provide for the purchase of two juvenile doses and two adult doses of epinephrine auto-injectors. If sufficient monies are not appropriated, the LEA may stock the epinephrine auto-injectors. Pursuant to a standing order issued by the chief medical officer of the Department of Health Services, a doctor of medicine or a doctor of osteopathy, a trained employee of an LEA who believes a pupil or adult is exhibiting symptoms of anaphylactic shock at school or a school-sponsored activity may administer an epinephrine auto‑injector (A.R.S. § 15-157).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Allows, rather than requires, LEAs to stock two or more juvenile doses and two or more adult doses of epinephrine auto-injectors.
2. Adds nurse practitioners and physician assistants to the health professionals who may issue a standing order for the administration of epinephrine auto-injectors.
3. Removes the requirement that ADE include a separate line item for an appropriation for the purchase of epinephrine auto-injectors in its annual budget request.
4. Allows school districts and charter schools to accept monetary donations or apply for grants for the purchase of epinephrine auto-injectors or participate in third-party programs to obtain them at fair market, free or reduced prices.
5. Removes the specification that the State Board of Education rules on annual training and procedures in the administration of auto-injectable epinephrine is as directed on the prescription protocol.
6. Makes technical and conforming changes.
7. Becomes effective on the general effective date.
