AMENDED

Purpose
Restricts universities and community colleges from prohibiting the possession of a nonlethal weapon on campus.
Background
Community college district boards maintain and oversee each community college in the district and must adopt policies to offer programs that meet the educational needs of the population served by community colleges and enforce courses of study (A.R.S. § 15-1444).
The Arizona Board of Regents (ABOR) is the governing board for Arizona's public universities: Arizona State University, Northern Arizona University and the University of Arizona. ABOR provides policy guidance in areas such as: 1) academic and student affairs; 2) financial and human resource programs; 3) student tuition, fees and financial aid programs; 4) university capital development plans; 5) strategic plans; 6) legal affairs; and 7) public and constituent outreach (A.R.S. § 15-1626).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Restricts universities and community colleges from prohibiting the possession of a nonlethal weapon on campus.
2. Allows universities and community colleges to adopt rules and disciplinary standards if a nonlethal weapon is used or displayed in a non-emergency manner.
3. Defines nonlethal weapon as a weapon explicitly designed, manufactured, and marketed for personal protection consumer use, is non-explosive, and is designed and developed to incapacitate or repel a person with a low probability of fatality or permanent injury, or to disable equipment with minimal undesired damage or impact on the environment.
4. Becomes effective on the general effective date.
