Purpose
Requires a school district, city or town to call elections no later than 120 days before the date of the election.
Background
Statute requires special districts to call nonpartisan elections no later than 120 days before the date of the election. Nonpartisan is defined as an election that is held by a special district and is not held concurrently with the general election (A.R.S.§ 16-226).
To call an election, the governing body must publish a notice of election in a newspaper or mail a notice to each household containing a qualified elector of the district (A.R.S. § § 16-225 and 16-228). The notice must contain information about the election including the date of the election, location of the polls, the hours the polls will be open, the purpose of the election or the election district conducting the election. Notices published in a newspaper must be published twice in a newspaper of general circulation during the six calendar weeks preceding twenty days before the election. Notices sent by mail must be delivered to households before the earliest date of mailing to registered voters of any requested early ballots for that election (A.R.S § 16-228).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires a school district, city or town to call elections, that are not held concurrently to a general election, no later than 120 days before the date of the election.
2. Makes technical changes.
3. Becomes effective on the general effective date.
