county improvement districts; repayment agreements

 

Purpose

 

Modifies County Improvement District (District) authority regarding the construction, maintenance and improvement of waterworks and drinking water treatment facilities.

 

Background

 

The board of supervisors of a county may establish a District in an unincorporated area in which the District is located for the purposes of construction and operation of a wastewater treatment facility, making other improvements or acquisitions for the benefit of the District. A District may issue bonds or levy taxes to provide or contract for these services (A.R.S. § 48-902). The board of supervisors of the county in which the District is located serves as the board of directors of the District (A.R.S. § 48-908).

 

The Water Infrastructure Finance Authority (WIFA) finances construction, acquisition or improvements to wastewater treatment facilities, drinking water facilities and other water quality facilities for political subdivisions, Indian tribes and eligible drinking water facilities and projects (A.R.S. § 49-1203).

 

Current law allows a District to enter into a financial assistance loan repayment agreement with WIFA for the construction or improvement of a wastewater treatment facility, sewer collection system or nonpoint source project (A.R.S. § 48-909.01).

 

Waterworks is currently defined as works for the storage or development of water for domestic uses and includes wells, pumping machinery, power plants, pipelines and all equipment necessary for those purposes (A.R.S. § 48-901).

 

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.      Allows the District's board of directors to maintain waterworks.

 

2.      Allows the District to construct, maintain or repair drinking water treatment facilities with monies provided by WIFA.

 

3.      Includes drinking water treatment facilities in the definition of waterworks.

 

4.      Makes technical and conforming changes.

 

5.      Becomes effective on the general effective date.
