FACT SHEET FOR H.B. 2323

 

schools; inhalers; contracted nurses

 

Purpose

 

Allows a nurse contracting with a school district or charter school to administer an inhaler.

 

Background

 

Pursuant to a standing order issued by a chief medical officer of a county health department, a licensed physician, or a licensed nurse practitioner, trained school district or charter school employees may administer or assist in administering an inhaler to a student or adult at school or a school-sponsored activity if the employee believes in good faith that the person is exhibiting symptoms of respiratory distress (A.R.S. § 15-158).

 

School district and charter school governing bodies prescribe policies and procedures for the emergency administration of inhalers by trained employees (A.R.S. §§ 15-189.04 and 15‑342).

           

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.      Expands who may administer or assist in administering an inhaler at school or a school‑sponsored activity to include nurses contracting with a school district or charter school.

 

2.      Extends immunity from civil liability to nurses contracting with a school district or charter school concerning the good faith administration of an inhaler.

 

3.      Makes technical and conforming changes.

 

4.      Becomes effective on the general effective date.
