sale of eggs; expiration date

 

Purpose

 

Increases from 24 days to 45 days, the expiration date for Grade A eggs.

 

Background

 

The Arizona Department of Agriculture (AZDA) Animal Services Division conducts inspections for dairy, eggs, livestock, meat and poultry. The Egg Products Control Program (EPCP) inspects all shell eggs and egg products sold in the state. Locations where eggs are sold or stored are subject to inspection to verify that the products meet quality, weight, labeling and refrigeration requirements (AZDA).

 

AZDA complies with all standards, grades and weight classes for shell eggs established by the United Sates Department of Agriculture (A.A.C. R3-2-902).

 

Candling is defined as the visual inspection of an egg by transmitted light to determine the quality and grade based on cleanliness, size and condition of the egg's air cell, yoke and white (A.R.S. § 3-701).

 

Expiration date is defined as sell by or buy thru followed by a date, including the month and day. Current statute requires the expiration date for both Grade AA and Grade A eggs to be not more than 24 days after the eggs were candled, including the day they were candled (A.R.S. § 3-701).

 

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

 

Provisions

 

1.      Modifies the definition of expiration date to include:

a)      for Grade AA eggs, not more than 24 days after the eggs were candled; and

b)      for Grade A eggs, not more than 45 days after the eggs were candled.

 

2.      Makes technical and conforming changes.

 

3.      Becomes effective on the general effective date.
