FLOOR AMENDMENT EXPLANATION

 

1.    Increases, from 3 to 6, the number of missed restitution payments that triggers a review hearing to determine whether there is cause to find a defendant in contempt.

 

2.    Exempts missed payments of fees, fines and incarceration costs from the review hearing requirement.

 

3.    Exempts defendants from the hearing requirement who have a compelling reason to not hold a hearing, if the defendant's supervising probation officer provides written confirmation and notification is provided to the victim.

 

4.    Requires the victim to be informed of the right to attend and be heard at the hearing.

Line 9, strike "three or more consecutive" insert "six"

Line 13, after "13‑810" insert "Unless the supervising probation officer certifies in writing to the court that the officer has independently confirmed that there is a compelling reason to not hold a hearing and provides a copy of the certification to the victim who is entitled to receive the restitution"

Line 16, after the period insert "The victim who is entitled to the restitution shall be informed of the hearing and the right to attend and be heard at the hearing."
