AN ACT

 

amending Title 9, chapter 7, article 4, Arizona Revised Statutes, by adding section 9-842; amending Title 11, chapter 11, article 1, Arizona Revised Statutes, by adding section 11-1612; relating to local regulation.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 7, article 4, Arizona Revised Statutes, is amended by adding section 9-842, to read:

START_STATUTE9-842.  Occupational fee and licensing requirements on certain professions; prohibition

A.  A municipality may not impose an occupational fee or licensing requirement on any of the following professions:

1.  Palmist.

2.  Phrenologist.

3.  Astrologer.

4.  Soothsayer.

5.  Fortune teller.

6.  Mind reader.

7.  Clairvoyant.

8.  Tarot card reader.

9.  Busker or street performer.

10.  Transient merchant.

11.  Peddler.

12.  Canvasser.

13.  Solicitor.

14.  Auctioneer.

15.  Junk dealer.

16.  Secondhand dealer.

17.  Christmas tree merchant.

18.  Window washer.

19.  Florist.

20.  Interior designer.

21.  Photographer.

B.  If a municipality imposes an occupational fee or licensing requirement on any of the professions listed in subsection A of this section that is in effect on the effective date of this section, the occupational fee or licensing requirement does not apply and may not be enforced.

C.  This section does not prohibit or restrict a municipality from:

1.  Issuing a business or industry license.

2.  Adopting or enforcing a zoning ordinance relating to a business or industry. END_STATUTE

Sec. 2.  Title 11, chapter 11, article 1, Arizona Revised Statutes, is amended by adding section 11-1612, to read:

START_STATUTE11-1612.  Occupational fee and licensing requirements on certain professions; prohibition

A.  A county may not impose an occupational fee or licensing requirement on any of the following professions:

1.  Palmist.

2.  Phrenologist.

3.  Astrologer.

4.  Soothsayer.

5.  Fortune teller.

6.  Mind reader.

7.  Clairvoyant.

8.  Tarot card reader.

9.  Busker or street performer.

10.  Transient merchant.
