AN ACT
amending section 48-3702, Arizona Revised Statutes; relating to multi‑county water conservation districts.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 48-3702, Arizona Revised Statutes, is amended to read:
48-3702. District as municipal corporation; immunity
A. A multi‑county water conservation district is a tax-levying public improvement district of the state and a municipal corporation to the extent of the powers and privileges conferred by this chapter or granted generally to municipal corporations by the constitution and statutes of the state, including the immunities and exemptions provided by article 13 XIII, section 7, of the Constitution of Arizona.
B. A multi-county water conservation DISTRICT shall not assert the defense of immunity under the eleventh amendment of the United States Constitution in litigation brought by a water user to enforce the terms of a central Arizona project water delivery contract or subcontract.
