· Inserts the phrase “recklessly commits a violation” to provide the courts with the ability to determine if a violation is a liability crime.
· Includes the right to a jury trial when determining restitution above $10,000.

Page 1, line 8, strike "violates" insert "recklessly commits a violation of"
Page 2, strike lines 11 through 13, insert:
"G. If restitution is sought in an amount exceeding ten thousand dollars, a person charged under this section is entitled to a jury trial on the issue of restitution and may raise any defense available in civil proceedings, including contributory negligence, comparative fault, nonparty at fault and duty to mitigate damages."
