AN ACT
amending Title 41, chapter 37, article 2, Arizona Revised Statutes, by adding section 41-3954; appropriating monies; relating to the Arizona department of housing.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 41, chapter 37, article 2, Arizona Revised Statutes, is amended by adding section 41-3954, to read:
41-3954. Eviction prevention fund; exemption
A. The eviction prevention fund is established consisting of legislative appropriations and any other monies. The department shall administer the fund. Monies in the fund are subject to legislative appropriation. The department shall distribute monies in the fund to both:
1. Eviction-vulnerable tenants to provide emergency financial assistance.
2. Community-based public or nonprofit organizations to enable the organizations to provide assistance to eviction-vulnerable tenants.
B. The department shall establish applicant eligibility criteria and application and selection procedures, including:
1. Defining who is considered an eviction-vulnerable tenant.
2. Determining how often a person may apply for monies pursuant to this section.
3. Determining how much monies a person may receive in total pursuant to this section.
4. Determining how an eviction-vulnerable tenant may demonstrate financial need to the department.
C. Monies in the fund are exempt from the provisions of section 35‑190 relating to lapsing of appropriations.
Sec. 2. Appropriation; eviction prevention fund
The sum of $1,000,000 is appropriated from the state general fund in fiscal year 2019-2020 to the eviction protection fund established by section 41-3954, Arizona Revised Statutes, as added by this act.
