HOUSE OF REPRESENTATIVES AMENDMENTS TO H.B. 2734

Strike everything after the enacting clause and insert:
"Section 1. Taxation of prime contracting study committee; membership; duties; report; delayed repeal
A. The taxation of prime contracting study committee is established consisting of the following members:
1. Three members of the senate who are appointed by the president of the senate, not more than two of whom are members of the same political party. The president of the senate shall designate one of these members to serve as cochairperson of the committee.
2. Three members of the house of representatives who are appointed by the speaker of the house of representatives, not more than two of whom are members of the same political party. The speaker of the house of representatives shall designate one of these members to serve as cochairperson of the committee.
3. Two persons who are actively engaged in the business of prime contracting. The president of the senate shall appoint these members.
4. One person who represents an association of counties in this state. The president of the senate shall appoint this member.
5. One person who represents a city or town in this state with a population of more than five hundred thousand persons and who has experience in the administration of transaction privilege tax. The speaker of the house of representatives shall appoint this member.
6. One person who represents a city or town in this state with a population of five hundred thousand persons or less and who has experience in the administration of transaction privilege tax. The speaker of the house of representatives shall appoint this member.
7. One person who is considered an expert in the field of transaction privilege taxes. The speaker of the house of representatives shall appoint this member.
8. One person who represents a statewide taxpayer association. The speaker of the house of representatives shall appoint this member.
9. The director of the department of revenue or the director's designee.
B. The study committee shall:
1. Analyze the legal framework surrounding the taxation of prime contracting.
3. Study best practices from other states and policy experts on the taxation of prime contracting.
4. Study compliance elements, including ways to decrease noncompliance with the taxation of prime contracting.
C. The study committee may:
1. Request information, data and reports from the department of revenue.
2. Hold hearings and receive public testimony.
D. The study committee shall convene at any time and in any place deemed necessary or convenient by the cochairpersons and all meetings shall be open to the public.
E. Committee members are not eligible to receive compensation.
F. The committee members appointed pursuant to subsection A, paragraphs 3 through 9 of this section are nonvoting advisory members whose presence is not counted for the purpose of determining the presence of a quorum.
G. On or before November 15, 2019, the study committee shall submit a report of its findings and recommendations to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state.
H. This section is repealed from and after September 30, 2020."
