History

A.R.S. § 28-6501 requires that monies collected from the motor fuel tax, the use fuel tax, the vehicle license tax, vehicle registration fees, motor carrier fees, and other miscellaneous fees be deposited in HURF. The Arizona Department of Transportation (ADOT) is required to allocate and transfer $1 million of HURF monies to the Economic Strength Fund each fiscal year (A.R.S. § 28-6534). Additionally, ADOT is required to allocate and transfer $10 million from HURF to the Department of Public Safety (DPS) for funding a portion of highway patrol costs each fiscal year.

After initial distributions, ADOT is required to allocate, and the State Treasurer is required to distribute remaining monies in HURF as follows: 1) 50.5% to the State Highway Fund (Fund); 2) 9% to counties; 3) 27.5% to incorporated cities and towns; and 4) 3% to incorporated cities with a population of 300,000 or more (A.R.S. § 28-6538).

HURF Revenues to the Fund are further distributed allocating 12.6% for specified transportation projects in Maricopa and Pima County (75% to Maricopa County and 25% to Pima County) (A.R.S. § 28-6538). The remainder of the Fund is allocated to ADOT for state highway projects and operating costs.   

Provisions

1.       Distributes $10 million in HURF revenues in FY 2021 to counties with a population of less than 250,000 as follows:

a.       $250,000 to each individual county; and

b.       The remainder to be distributed proportionally to each county based on population. (Sec. 1)

2.       Distributes $8 million in HURF revenues to cities and towns with a population of less than 7,500 persons as follows:

a.       $100,000 to each city or town; and

b.       The remainder to be distributed proportionally to each city or town based on population. (Sec. 1)

3.       Stipulates that the distributions are in addition to any other HURF monies distributed to counties, cities and towns. (Sec. 1)  

4.       Instructs the ADOT to use the 2016 population estimate from the US Census Bureau. (Sec. 1)

5.       Limits the use of the monies distributed to street or highway projects. (Sec. 1)

6.       Contains a Legislative intent clause that states the $18 million to be distributed is from the anticipated increase in HURF monies in FY 2021. (Sec. 2)
