Eliminates certain mandatory penalties for repeat felony offenders and liquor- and drug-related probation violations and gives discretion to the juvenile court.
History
The juvenile court must place any juvenile aged 14 or older and adjudicated as a repeat felony juvenile offender in juvenile intensive probation (A.R.S. § 8-341(D)). At the discretion of the court, juvenile intensive probation may involve home arrest and electronic monitoring, incarceration in a juvenile detention center, or commitment to the department of juvenile corrections.
Arizona law classifies a juvenile as a repeat felony juvenile offender if adjudicated delinquent more than once for offenses that would be felonies if committed by an adult (A.R.S. § 8-341(W)).
A juvenile adjudicated delinquent for an offense involving the purchase, possession, or consumption of liquor, or for the possession, use, manufacture, or sale of certain drugs or drug paraphernalia, violates juvenile probation if the juvenile consumes liquor or uses certain drugs while on probation (A.R.S. §§ 8-341(U)). Upon a third or subsequent liquor- or drug-related probation violation, the juvenile court must either revoke the juvenile's probation or select additional probation conditions, potentially including detention, GPS monitoring, additional alcohol or drug treatment, community restitution, additional testing, or a monetary assessment.
Provisions
1. Permits, rather than mandates, a juvenile court to place a repeat juvenile offender on juvenile intensive probation (Sec 1).
2. Eliminates the requirement that the juvenile court hold a hearing and either revoke probation or select additional probation conditions when a juvenile adjudicated delinquent for liquor- or drug-related offenses consumes liquor or uses certain drugs three or more times while on juvenile probation (Sec 1).
