Exempts an adult behavioral health therapeutic home from physical plant or zoning standards for a health care institution.
History
The Arizona Department of Health Services (DHS) Division of Licensing Services (Division) licenses and monitors health and child care facilities and providers throughout Arizona. Licensing inspections, on-site surveys, and complaint investigations are conducted to promote quality care and safety and ensure that performance standards are met for facility operation and maintenance. The Division's mission is to protect the health and safety of Arizonans by providing information, establishing standards, and licensing and regulating health and child care services.
A.R.S. §36-421 sets forth provisions for the construction or modification of a health care institution. A licensee must include architectural plans and specifications or DHS' approval of the plans and specifications. These plans and specifications must meet the minimum standards for licensure within the class or subclass of institution for which it is intended. The Arizona Administrative Code, Title 9, Chapter 10 contains the rules for licensing health care institutions.
Provisions
1. Outlines adult behavioral health therapeutic home as being for individuals who are at least 18 years of age, have behavioral health issues and need behavioral health services, that does all of the following:
a. Provides room and board;
b. Assists in acquiring daily living skills; coordinates transportation to appointments;
c. Monitors behavior;
d. Assists in the self-administration of medication; and
e. Provides feedback related to behavior to case managers. (Sec. 1)
2. Allows for behavioral health services to be provided under the clinical oversight of a behavioral health professional. (Sec. 1)
3. Establishes that an adult behavioral health therapeutic home is not required to comply with the physical plant or zoning standards for a health care institution. (Sec. 2)
4. Makes conforming changes. (Sec. 1, 2)
