Summary of the Strike-Everything Amendment to HB 2108
Overview
Exempts a correctional officer employed by the Arizona Department of Corrections (ADC) from jury service for three years.
History
All qualified citizens have an obligation to serve on juries when summoned by the courts, unless excused. Statute currently lists certain individuals who are temporarily excused from jury duty if the judge or jury duty commissioner finds that any of the following apply:
a. The prospective juror has a mental or physical condition that causes the juror to be incapable of performing jury service;
b. Jury service by the prospective juror would substantially and materially affect the public interest or welfare in an adverse manner;
c. The prospective juror is not currently capable of understanding English;
d. Jury service would cause undue or extreme physical or financial hardship to the prospective juror or a person under their care or supervision;
e. The prospective juror is an employed peace officer certified by the Arizona Peace Officer Standards and Training Board;
f. A judge or jury commissioner excuses the prospective juror for good cause based on a showing of undue or extreme hardship under the circumstances; or
g. The prospective juror is summoned within four years after serving on a grand jury (A.R.S. § 21-202).
Provisions
1. Expands the list of individuals entitled to be temporarily excused from jury service to include a prospective juror employed in the correctional officer class series by ADC until January 1, 2023. (Sec. 1,2)
