Summary of the Strike-Everything Amendment to HB 2110

Overview

History

Current statute prohibits a person from distributing, selling, offering for sale, importing or installing any plumbing fixture for use in any new residential, commercial, industrial or public construction or from replacing existing plumbing fixtures that do not meet the following water saving performance standards:

a.       Residential lavatory and kitchen faucets and replacement aerators that deliver an average of no more than 3 gallons of water per minute at a pressure of 80 PSI;

b.       Commercial, industrial and public lavatory faucets that are either:

                     i.            Equipped with a mechanism that causes the faucet to close automatically after delivering no more than ¼ of a gallon of water; or

                   ii.            Designed to deliver an average of no more than ½ of a gallon of water per minute at a pressure of 80 PSI;

c.        Shower heads designed to deliver an average of no more than 3 gallons of water per minute at a pressure of 80 PSI;

d.       Water closets designed to use an average of no more than 1.6 gallons of water per flush;

e.       Urinals designed to use an average of no more than 1 gallon of water per flush;

f.         Evaporative cooling systems and decorative fountains equipped with water recycling or reuse systems.

Urinals that use a timing device to flush periodically regardless of demand are prohibited (A.R.S. §§ 45-312 & 45-313).

The Director of the Arizona Department of Administration (ADOA) is required to install as many water free urinals in as many state buildings as possible if it is determined that their use is in the best interest of the State, given all circumstances (A.R.S. § 45-313.01).

Provisions

1.       Outlines new water saving performance standard requirements beginning in 2020 as follows:

a.       Residential lavatory and kitchen lavatory faucets and replacement aerators that deliver an average of no more than 1½ gallons of water per minute at a pressure of 80 PSI;

b.       Shower heads that deliver an average of no more than 2 gallons of water per minute at a pressure of 80 PSI;

c.        Water closets that use an average of no more than 1.28 gallons of water per flush; and

d.       Urinals that use an average of no more than ½ of a gallon of water per flush. (Sec. 1,2)

2.       Retains the current standards relating to:

a.       Commercial, industrial and public lavatory faucets;

b.       Urinals with timing devices; and

c.        Evaporative cooling systems and decorative fountains. (Sec. 1,2)

3.       Requires the Director of ADOA to install as many water free urinals in as many state buildings as possible, rather than only if it is determined to be in the best interest of the State. (Sec. 3)

4.       Exempts any plumbing fixture that is documented to have been purchased and is actually located in Arizona before January 1, 2020 from the new performance standards. (Sec. 4)
