Overview

Permits a person making court-ordered installment payments following a division of property to a spouse convicted and sentenced to at least 80 years or life in prison to ask the court to modify the payment, regardless of when the conviction occurred.

History

In a divorce, legal separation, or disposition of property proceeding, the court must divide the couple's community property and assign the spouses their separate property (A.R.S. § 25-318). The court may, as part of its division of property, require one spouse to make a lump sum or installment payments to the other spouse.

A person required to make installment payments pursuant to a division of property can ask the court to modify the payment if, after the division, the person receiving the payments is convicted and sentenced to at least 80 years or life in prison (A.R.S. § 25-318.02).
