History

Title 28, Chapter 3 outlines traffic and vehicle regulations for traffic signs, operating a vehicle on road ways, right-of-ways, and off highways, and pedestrian rights. 

Pursuant to A.R.S. § 28-904, vehicles are prohibited from driving on sidewalks except for permanent or duly authorized temporary driveways.  A vehicle is a device in, on or by which a person or property is or may be transported or drawn on a public highway.  Electric bicycles and devices moved by human power, devices used exclusively on stationary rails or tracks, personal delivery devices are not classified as vehicles (A.R.S. § 28-101).

Provisions

1.       Defines personal mobile cargo carrying device as an electronically powered device that:

a.       Transports personal property primarily on sidewalks and in crosswalks;

b.       Weighs less than 80 pounds, excluding cargo;

c.        Operates at a maximum speed of 12 miles per hour;

d.       Uses monitoring technology designed to remain within 25 feet of the owner; and

e.       Comes to a controlled stop when the braking system is active or engaged. (Sec. 1, 2, 3)

2.       Permits the operation of a personal mobile cargo carrying device on a sidewalk. (Sec. 4, 5)

3.       Grants the operator of a personal mobile cargo carrying device all the rights and duties given to pedestrians that pertain to traffic and vehicle regulation, driving under the influence, and penalties and procedures for vehicle violations. (Sec. 6)

4.       Excludes personal mobile cargo carrying device from the definitions of motor vehicle, personal delivery device, and vehicle. (Sec. 1, 2, 3)

5.       Contains an effective date of September 1, 2020. (Sec. 7)

6.       Contains a conditional enactment clause. (Sec. 8)
