Summary of the Strike-Everything Amendment to HB 2181

Overview

Exempts cable-TV, satellite-TV and telecommunications providers from the Registrar of Contractors (ROC) licensure requirements.

History

In order to obtain a contractor's license under the ROC, an applicant must:

a. Submit an application that contains all required information;

b. Submit the appropriate fee;

c. Submit and maintain the appropriate bond; and

d. Notify the ROC of any change in the information required from the applicant within 30 days of the change.

Before being issued a license, an applicant must have at least four years of practical or management trade experience. At least two of these years must have been within the past 10 years and deal specifically with the type of construction for which the applicant is applying for licensure.

An applicant is also required to take a written examination to show: 1) qualification in the kind of work for which the applicant proposes to contract; 2) general knowledge of the building, safety, health and lien laws of the state; 3) general knowledge of the administrative principles of the contracting business and the rules adopted by the ROC; and 4) knowledge and understanding of construction plans and specifications applicable to the particular industry or craft (A.R.S § 32-1122).

A.R.S. § 32-1121 contains a list of individuals exempt from the ROC licensure requirements, including but not limited to public utilities operating under regulation of the Corporation Commission, gardeners and alarm agents. Some of these exemptions contain stipulations relating to the cost of a project.

Provisions

1. Exempts cable-TV, satellite-TV and telecommunications providers, including data and related services, from the ROC licensure requirements.

a. Specifies that this exemption includes contractors and subcontractors of cable-TV, satellite-TV and telecommunications providers if the work is limited to the installation of low voltage cable, phone, internet, data and related services. (Sec. 1)

2. Specifies that an electrical fixture or appliance that has internal batteries not exceeding 12 volts in a single, series or parallel configuration is not included when determining whether a project is exempt from a need for licensure based on cost. (Sec. 1)
