Establishes licensure and regulation requirements for Video Service Providers (VSP).
History
Laws 2018, Chapter 331, established uniform licensing and regulations of VSPs to promote, in part, streamlined licensing and uniform terms and conditions for VSPs. The law created uniform video service license agreements between applicants for VSPs and municipalities or counties, which outlines certain requirements for VSPs.
The law placed the governance of VSPs by cities, towns, and counties within Title 9 (Cities and Towns). Within the applicable sections of statute, local government applies to municipalities and counties. With the inclusion of "county" in the definition, this places the licensing and regulation of county licensed VSPs under Title 9 (Cities and Towns).
Provisions
County Regulation of VPS Equivalence
1. Establishes the licensing and regulation of VPSs under Title 11 (Counties), which govern the following:
a. Applicability of governance,
b. Uniform video service license agreements and licensure,
c. Incumbent cable operators,
d. Uniform video service license transfers,
e. Video service revocation,
f. Reporting requirements,
g. Federal law compliance,
h. Fees and charges,
i. Audits, and
j. Enforcement (Sec. 8).
2. Replicates Title 9 (Cities and Towns) statutes governing VSPs as established by Laws 2018, Chapter 331 (Sec. 8).
Deviations
3. Specifies the county must issue a uniform video service license no later than 45 days after the filing date, with exception (Sec. 8).
4. Adds a reference to the Video Service Provider Fund as applicable (Sec. 8).
Miscellaneous
5. Removes "county" references from statute relating to VSPs under Title 9 (Cities and Towns) (Sec. 1, 3, 4, 5).
6. Adds certain reports must be provided to the Secretary of State (Sec. 9).
7. Contains a legislative findings clause (Sec. 10).
8. Makes technical and conforming changes (Sec. 2, 6, 7, 9).
