Specifies that the Arizona Department of Transportation (ADOT) must require certain individuals to complete traffic survival school.
History
ADOT may suspend or revoke the license of an Arizona resident or the privilege of a nonresident to drive a motor vehicle in Arizona or may require a person to complete traffic survival school upon notice of a conviction of an offense in another jurisdiction that would be grounds for suspension or revocation of that person's license had the offense been committed in Arizona (A.R.S. § 28-3303).
ADOT may suspend or revoke the license of a driver or require a licensee to complete traffic survival school if ADOT records or other sufficient evidence show that the licensee:
a. Commits certain statutorily outlined offenses;
b. Has been involved as a driver in an accident resulting in death or injury or serious property damage; or
c. Is medically, psychologically or physically incapable of operating a motor vehicle.
ADOT is required to immediately notify a licensee in writing of suspension or revocation of their license or a requirement to complete traffic survival school. A person may request a hearing, which is required to be held within 60 days. At the hearing, ADOT is required to either rescind its order of suspension or revocation or requirement to complete traffic survival school or may uphold or extend the order. (A.R.S. § 28-3306).
Provisions
1. Specifies that ADOT must require a person who commits certain statutorily outlined offenses or meets certain criteria to complete traffic survival school. (Sec. 1,2)
o Currently, ADOT may suspend or revoke the license of these individuals or require them to complete traffic survival school (A.R.S. §§ 28-3303 & 28-3306).
2. Removes language specifying that a hearing may result in ADOT rescinding an order requiring specified licensees to complete traffic survival school. (Sec. 2)
3. Stipulates that if a licensee is required to complete traffic survival school and is noncompliant with this order, ADOT may suspend or revoke the person's license. (Sec. 2)
o Currently, ADOT may amend the order to suspend or revoke the license (A.R.S. § 28-3306).
4. Makes technical and conforming changes. (Sec. 2)
