History

A.R.S. § 28-3395 outlines the duties of the Supreme Court regarding defensive driving schools. The Supreme Court is required to: 1) supervise the use of schools by the courts; 2) make the amount of the court diversion fee and the total cost to attend a school in each court public; 3) establish an automated statewide database for keeping a record of individuals who attend a school; 4) adopt rules that establish certification criteria  for schools and instructors; 5) establish procedures for courts and schools to remit required reports; 6) certify and monitor schools and instructors that serve as a court authorized diversion program; and 7) require that a class not exceed four and a half hours, including testing, reviewing and grading.

An individual who is issued a citation for a civil traffic moving violation pursuant to statute or a local civil traffic ordinance is eligible to attend a defensive driving school. A court may also allow an individual to attend defensive driving school for a citation of criminal excessive speeding (A.R.S. § 28-3392).

If an individual successfully completes the course at a defensive driving school, the court is required to dismiss the civil or criminal traffic citation. In addition, the Arizona Department of Transportation is prohibited from including the civil or criminal traffic citation on the individual's driving record (A.R.S. § 28-3394).

Arizona Code of Judicial Administration (ACJA) §§ 7-205(E) & 7-201(E) outline the certification requirements for a defensive driving school.

Provisions

1.       Specifies that the certification criteria for defensive driving schools must require each school to demonstrate that the course curriculum improves driving behavior. (Sec. 1)

2.       Allows a defensive driving school to satisfy the aforementioned requirement by submitting either:

a.       An independent study by an accredited academic institution, industry association or governmental or regulatory body; or

b.       Proof that the course curriculum is accredited by a generally accepted, national, academic or continuing education credentialing body. (Sec. 1)
