History

A certificate of necessity (CON) is issued to an ambulance service by the Department of Health Services (DHS) and describes the service area, level and type of service, hours of operation, effective date, expiration date, legal name and address of the ambulance service, as well as any limiting or special provisions prescribed by the Director of DHS (Director) (A.R.S. § 36-2201).

The Director is required to adopt rules for the operation of ambulance services. The rules provide for DHS to issue, amend, transfer, suspend or revoke a CON (A.R.S. § 36-2232). An applicant for an initial CON is required to submit an application to DHS containing all required information (A.A.C. R9-25-902). To amend a CON, a certificate holder must submit the initial application and a filing fee of $50 for changes in the legal name and address of the ground ambulance service (A.A.C. R9-25-905).

An air ambulance service is required to send DHS written notice of a name change at least 30 days before making the change. Within 30 days after receiving the notice, DHS must issue an amended license that incorporates the name change but retains the expiration date of the current license (A.A.C. R9-25-707).
