Summary of the Strike-Everything Amendment to HB 2307

History

Pursuant to A.R.S. § 15-201(A), the State Board of Education (SBE) is composed of the superintendent of public instruction, the president of a state university or state college, four lay members, a president or chancellor of a community college district, an owner or administrator of a charter school, a classroom teacher, and a county school superintendent.

The Arizona Department of Education (ADE) has established a division adult education that is under SBE's jurisdiction. Pursuant to A.R.S. § 15-232, this division prescribes courses of study for adult education in school districts for training adults to continue their education so that they can pass an equivalency test approved by SBE. Additionally, ADE is required to make available and supervise adult education programs in other institutions and agencies in Arizona.

Provisions

1.       Requires SBE to establish the program. (Sec. 1)

2.       States that the program must provide public education to adult learners through partnerships between service providers and school districts, charter schools, or career and technical education districts. (Sec. 1)

3.       Establishes requirements for an eligible service provider. (Sec. 1)

4.       Allows an adult learner to receive a high school diploma if all graduation and SBE requirements are met. (Sec. 1)

5.       Requires the program to meet all applicable legal requirements for a public school, including student assessments, special education services, and prohibitions against admission limits. (Sec. 1)

6.       Prohibits the program from receiving transportation funding. (Sec. 1)

7.       Allows the program to receive base support level funding and additional assistance in the same manner as a school district or a charter school. (Sec. 1)

8.       Mandates ADE to develop application procedures for service providers that want to participate in the program. (Sec. 1)

9.       Requires SBE to evaluate service provider applications and to approve the providers who meet all expectations and specifies that the SBE's approval is subject to certain conditions. (Sec. 1)

10.   Requires the service providers to annually report information to ADE that includes: the number of students enrolled in the program, graduation rate of students, average student progress toward meeting graduation requirements, number and type of industry-recognized credentials earned by students, and a summary of academic, behavioral, and emotional support services the service provider offers. (Sec. 1)

11.   Requires ADE to submit an annual report about the program to the Governor, President of the Senate, and the Speaker of the House of Representatives on or before December 15 of each year. (Sec. 1)

12.   Allows SBE to approve service providers with a total enrollment of no more than 500 adult learners in FY 2021; 1,000 adult learners in FY 2022; and 2,500 adult learners in FY 2023 and each year after. (Sec. 1)

13.   Permits SBE to adjust the enrollment capacity of the program. (Sec. 1)

14.   Allows SBE to adopt rules to carry out the program. (Sec. 1)

15.   Terminates the program on July 1, 2029. (Sec. 1)
