History

Pursuant to A.R.S. §15-213, the State Board of Education (SBE) has to adopt rules for the procurement by school districts of any materials, services, goods, construction and construction services (R7-2-1001 et seq.). Laws 2018, Chapter 285, §§5 and 32 amended this statute by specifically requiring the SBE to adopt rules that school districts must award contracts based on the lowest qualified bidder, on or after June 30, 2019.

Provisions

1.       Establishes the Committee and describes the conditions of membership and duties for the members of the Committee.

2.       Requires the Committee to study procurement processes and resources currently used by school districts, focusing on transparency and efficiency of practices, and to study resources at the state level that can be used to support the school district procurement system.

3.       Allows the Committee to request information, data and reports from Arizona Department of Administration and the Arizona Department of Education, and to hold hearings and receive public testimony.

4.       Authorizes the Committee to convene at any time and place as deemed necessary and requires that all meetings are open to the public.

5.       Exempts Committee members from receiving compensation.

6.       Requires the Committee to submit a report of its findings and recommendations to the Governor, the President of the Senate, the Speaker of the House of Representatives and the Secretary of State, on or before November 15, 2019.

7.       Terminates the Committee from and after September 30, 2020.
