Overview

Requires the court to direct the Arizona Department of Transportation (ADOT) to either suspend or restrict driving privileges for a first-time motor vehicle offense resulting in serious injury or death. ☐ Prop 105 (45 votes) ☐ Prop 108 (40 votes) ☐ Emergency (40 votes) ☐ Fiscal Note

History

Certain first-time motor vehicle offenses resulting in serious injury or death require mandatory traffic survival school and, at the court's discretion, suspension of the defendant's license (A.R.S. § 28-672(A)). A person may not drive with a suspended license.

A person with a restricted license may drive between the person's:

1.       Residence and place of employment;

2.       Place of employment and school;

3.       Residence, place of employment, or school and a healthcare professional's office;

4.       Residence, place of employment or school and the probation officer's office;

5.       The person's residence, place of employment, or school and a certified ignition interlock device service facility;

6.       The person's residence and a location designated for parenting time; or

7.       The driver's residence and a dependent person's employment, school, or medical appointment (A.R.S. § 28-144).

Provisions

1.       Requires the court to direct ADOT to either suspend or restrict driving privileges for a first-time motor vehicle offense for a period of:

a.       90 to 180 days, if the violation results in serious physical injury; and

b.       180 days to one year if the violation results in death.
