Overview

Allows the Director of the Arizona Department of Environmental Quality (ADEQ) to take necessary corrective action for a public water or wastewater treatment facility or system☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal Note that is regulated by the Arizona Corporation Commission (ACC) if certain conditions are met.

History

The ACC has the authority to supervise and regulate all public service corporations in the state, which includes private water and wastewater systems and facilities (A.R.S. § 40-202).

In regard to water quality control, ADEQ is responsible for overseeing drinking water standards and wastewater treatment and disposal (A.R.S. Title 49, Chapter 2).

Provisions

1.       Allows the Director to take necessary corrective action for an ACC-regulated public water or wastewater treatment facility or system if both of the following occur:

a.       ADEQ does one of the following:

i.         Determines that the facility or system is out of compliance with an ADEQ-issued administrative order for a violation;

ii.       Files a civil action against the owner or operator for a violation; or

iii.     Determines that an emergency exists with the facility or system; and

b.       ADEQ determines the corrective action would expedite the facility's or system's return to compliance. (Sec. 1,2)

2.       Makes technical and conforming changes. (Sec. 1,2)
