☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NotePursuant to A.R.S. § 28-7058, the Arizona Department of Transportation (ADOT) is permitted to 1) privatize any rest area constructed on or adjacent to state highways in Arizona; 2) establish the State Certified Rest Area Program that meet requirements established by the Federal Highway Administration; and 3) contract with a third party or other government entity to certify and recertify areas for the State Certified Rest Area Program. Any agreement between ADOT and a person for privatization must include a provision that: 1) prohibits the person from changing fees for the use of a lavatory; and 2) requires the person to provide an adequate outdoor picnic area to be available to the public at no charge. The State Certified Rest Area Program sunsets on July 1, 2019.

Additionally, ADOT is permitted to establish the Rest Area Sponsorship Sign Program. ADOT may contract with a third party to install, maintain and replace rest area sponsorship signs at rest areas located in the right-of-way of the interstate or state highway system. The third party is required to agree in a contract to lease sponsor recognition space and to furnish, install, maintain and replace signs for the benefit of business or organizational sponsors. Costs incurred under the program must be paid under agreements negotiated between the third party and business organization sponsors. ADOT is permitted to enter into a revenue sharing agreement with the third party. ADOT must deposit all monies received from the revenue sharing agreement into a subaccount of the state highway fund for rest area maintenance, operation and repair. The Rest Area Sponsorship Sign Program sunsets on July 1, 2019 (A.R.S. § 28-7059).
