History

The Director of the Department of Health Services (DHS) is required to adopt rules on prescribing requirements regarding school attendance and the approved means of immunizations. These rules must include the required dose and optimal ages for administering the immunization. Rule standards for documentary proof is developed by the Director in consultation with the superintendent of public instruction. (A.R.S. § 36-672)

A student is prohibited from being immunized without the informed consent of a parent, guardian or person in loco parentis of the student. The local health department is required to provide the immunizations for school attendance at no cost to the student, parent, guardian or person in loco parentis. (A.R.S. § 36-673)

Provisions

1.       Identifies the information a health care professional, who administers vaccines, must provide to a patient, parent, guardian, or person in loco parentis to include:

a.       The benefits and risks of each vaccine;

b.       The vaccine manufacturer's product insert;

c.        The vaccine's excipient and media summary from the Centers for Disease Control and Prevention; and

d.       Instructions on how to report a vaccine-adverse event. (Sec. 1)

2.       Requires that the aforementioned information be included in any informational or educational materials DHS develops or provides to parents or guardians for informed consent. (Sec.2)

3.       States that a pupil may not rather than shall not be immunized without the informed consent of the parent, guardian or person in loco parentis. (Sec. 3)
