History

A person commits misconduct involving weapons by knowingly possessing a deadly weapon on school grounds. Statute outlines certain exceptions to this provision which include:

a.       A peace officer or anyone summoned by a peace officer to assist in the performance of official duties;

b.       A member of the U.S. military forces in the performance of official duties;

c.        A warden, deputy warden, community correctional officer, detention officer, special investigator or correctional officer of the Arizona Department of Corrections or Department of Juvenile Corrections;

d.       A person licensed, authorized or permitted pursuant to state or federal law;

e.       A weapon possessed for the purposes of preparing for, conducting or participating in hunter or firearm safety courses;

f.         A firearm that is unloaded and carried in a means of transportation under the control of an adult, provided that if the adult leaves the means of transportation, the firearm is not visible, and the means of transportation is locked;

g.       A firearm for use on school grounds in a program approved by a school; and

h.       A firearm carried by a person who possesses a certificate of firearms proficiency and is authorized to carry a concealed firearm under federal law (A.R.S. § 13-3102).

Provisions

1.       Specifies that a person does not commit misconduct involving weapons for knowingly possessing a loaded or unloaded firearm on school grounds that is carried within a means of transportation and under the control of an adult. (Sec. 1)

o   Currently, this exception only applies to a firearm that is unloaded (A.R.S. § 13-3102).
