History

The Arizona Department of Transportation (ADOT) may verify financial responsibility of the owner of a motor vehicle involved in an accident in Arizona. If the accident involves an unregistered vehicle, ADOT may conduct financial responsibility verification in the same way as a registered vehicle. If the evidence of financial responsibility is false or invalid, ADOT must send a suspension notice to the owner that the person's driver license and motor vehicle registration will be suspended fifteen days after the date the notice is mailed, unless a hearing is requested.

If the person who appears as the registered owner of the vehicle, according to ADOT records, is able to provide proof as prescribed by the director of ADOT that the vehicle was sold before the date of the accident, ADOT shall not suspend the driver license or registration privileges of the person (A.R.S § 28-4143).

Provisions

1.       States that the driver license and registration of a registered owner of a vehicle involved in an accident will not be suspended if the vehicle was sold before the accident occurred, rather than before the date of the accident. (Sec. 1)
