Allows the Arizona Department
of Education (ADE) to provide schools, school districts, third-party
entities and agencies with information relating to the investigation of a
certificate holder employed by any school or school district.
History
The State Board of Education (SBE) oversees certifications for individuals involved with student instruction including teachers, speech therapists, principals and superintendents. The SBE and ADE investigate certification related matters, including alleged unprofessional or immoral conduct of a certificate holder (A.R.S. § 15-203).
Pursuant to A.R.S. § 15-350, a school or school district that employs a certificate holder during the time of alleged conduct that constitutes grounds for disciplinary action is required to make records, documents and evidence available to the SBE or ADE upon request. Investigation-related information, records and reports are confidential, but the ADE may release, for employment purposes, investigation related information to a school or school district that currently employs the certificate holder under investigation.
Provisions
1. Allows the ADE to provide information, records, or reports relating to the investigation of a certificate holder to the following entities:
a. any school or school district to which the certificate has applied for employment;
b. any third-party entity that contracts with a school or school district to provide educators to which the certificate holder has applied to for employment; and
c. any agency that is investigating an application for certification or licensure by the certificate holder to make a certification or licensure decision.
