Allows a trained school district, charter
school, private school, and preschool employee to administer certain
medications, in a case of emergency, to a minor without parental or guardian authorization.
History
Every school district and charter school governing body is required to establish policies and procedures for school district or charter school employees to administer medication to students. If a student is a minor, the medication may only be administered to a student if the parent or legal guardian authorizes consent or writes a request authorizing consent for an employee to administer the medication (A.R.S. § 15-344(A)).
A school district or charter school employee who is trained to administer the following medications can administer to a student or adult in certain circumstances:
· epinephrine auto-injectors if the employee in good faith believes the individual is exhibiting symptoms of anaphylactic shock (A.R.S. § 15-157);
· inhaler if the employee in good faith believes the individual is exhibiting symptoms of respiratory distress (A.R.S. § 15-158); or
· naloxone hydrochloride, or any other opioid antagonist approved by the U.S. Food and Drug Administration (FDA), if the employee in good faith believes the individual is exhibiting symptoms of opioid-related overdoses, at school or at a school-sponsored activity (A.R.S. § 15-341(A)(43)).
Additionally, a nurse who is under contract with a school district or charter school can also administer an inhaler to a student or an adult if they in good faith believe the individual is exhibiting symptoms of respiratory distress at school or at a school-sponsored activity (A.R.S. § 15-158).
Provisions
1. Allows a trained school district or charter school employee, in a case of emergency, to administer epinephrine auto-injectors, inhalers, and naloxone hydrochloride, or any other opioid antagonist approved by the FDA, to a minor without parental or legal guardian consent. (Sec. 1)
2. Permits a nurse, who is under contract with a school district or charter school, to administer an inhaler to a minor without parental or legal guardian consent in a case of an emergency. (Sec. 1)
3. Allows trained private school and preschool employees to administer an inhaler to an individual immediately if the individual is experiencing respiratory distress. (Sec. 2)
4. Mandates private school and preschool employees to complete an initial training for the use of inhalers and subsequent training every two years at minimum. (Sec. 2)
5. Permits a private school and preschool to accept money to purchase inhalers and spacers or donations of inhalers and spacers directly from the manufacturer. (Sec. 2)
6. Allows a private school and preschool to collect and stock inhalers and spacers. (Sec. 2)
7. Requires trained private school and preschool employees to be responsible for the storage and oversight of inhalers and spacers. (Sec. 2)
8. Makes technical corrections. (Secs. 1 & 2)
