Includes the Department of Child Safety (DCS) as a licensing authority for juvenile group home contractors or subcontractors.
History
A.R.S. § 36-1201 defines a licensing authority as the state agency or its division, office, section, bureau or program that is responsible for licensing group homes. Group homes are a residential facility that is licensed to serve more than four minors at any one time and provide services pursuant to a contract for minors who are determined to be dependent, delinquent or incorrigible or minors with developmental disabilities, mental health or substance abuse needs. A contracting authority means a regional behavioral health authority or state agency or its division, office, section, bureau or program that is responsible for the administration and monitoring of contracts with group homes.
State agencies that contract directly with group homes or regional behavioral health authorities that subcontract with group homes are required to: 1) provide a safe, clean and humane environment; 2) be responsible for the supervision of residents while in the home or engaged in off-site activities affiliated with the group home; and 3) be licensed by either the Department of Health Services (DHS) or the Department of Economic Security (DES) (A.R.S. § 36-1201).
