Modifies the fee applied to the daily
storage of an impounded vehicle.
History
Pursuant to A.R.S. § 28-3511, a peace officer is required to remove and either immobilize or impound a vehicle for a 30-day period under specified conditions including if: 1) a person is driving while the their driving privilege is revoked for any reason; 2) a person has not been issued a valid driver license or permit by Arizona or another jurisdiction; or 3) a person is subject to an ignition interlock device requirement and is operating a vehicle without a functioning certified ignition interlock device.
The storage fee related to the impoundment of the vehicle is required to be $15 per day of storage, including any time the vehicle remains in storage after the end of the 30-day impoundment period (A.R.S. § 28-3512).
Provisions
1. Modifies the daily $15 storage fee applied to an impounded vehicle to reflect the average change in the Phoenix Consumer Price Index between August 25, 2004 and the effective date of this Act. (Sec. 1)
2. Requires the storage fee to be annually adjusted according to the change in the Index. (Sec. 1)
