History

A nonprescription drug, otherwise known as an over-the-counter drug, is defined as any nonnarcotic medicine or drug that may be sold without a prescription and that is prepackaged and labeled for use by the consumer in accordance with the requirements of the federal and state laws. Nonprescription drugs do not include drugs that are primarily advertised and promoted professionally to medical practitioners and pharmacists, controlled substances, drugs with the label 'Rx only', and drugs intended for use by hypodermic injection (A.R.S. § 32-1901).

The Board's mission is to protect the health, safety and welfare of the citizens of Arizona by regulating the practice of pharmacy and the manufacturing, distribution, sale and storage of prescription medications and devices and non-prescription medications. The Board's duties include issuing licenses to pharmacists, pharmacy interns and pharmacy technicians and issuing permits to pharmacists, manufacturers, wholesalers, distributors, non-prescription retailers and third-party logistics providers.

A.R.S. § 32-1930 permits the Board to issue to an applicant a nonprescription drug permit to sell, retail, stock, expose or offer for sale at retail nonprescription drugs. The biennial permit fee for a nonprescription drug permit is not more than $200 and the biennial permit fee for a nonprescription drug wholesale permit is not more than $500 (A.R.S § 32-1931).

Provisions

1.       Removes the allowance for the Board to issue a nonprescription drug permit to sell, retail, stock, expose or offer for sale nonprescription drug in the original package. (Sec. 1)
