Redefines home school district as the school district or charter school where a child last attended, rather than the school district in which the person with legal custody of the child resides.
History
A school district must enroll a school-age child with a disability and provide any necessary special education and related services, upon the request of the Department of Economic Security (DES), the Department of Child Safety (DCS) or the Arizona Health Care Cost Containment System (AHCCCS). The child must reside in a residential facility or foster care home, operated or supported by DES, DCS or AHCCCS, that is located in that school district (A.R.S. § 15-765(B)).
However, when a school district is unable to provide satisfactory education and services through its own facilities and personnel, a school district or county school superintendent may contract with other public or private schools, institutions and agencies. No school district may contract or make payments unless the child is evaluated and placed by a school district (A.R.S. § 15-765(D)).
The home school district must conduct an evaluation of the child or review the educational placement of a student who has been determined eligible for special education services. The school district must notify the appropriate state placing agency when a child requires an evaluation for possible services. If the individualized education program determines that a residential special education placement is the least restrictive environment in which an appropriate educational program can be provided, the home school district must submit documentation to the Arizona Department of Education as outlined (A.R.S. § 15-765(E)).
Statute currently defines home school district as the school district in which the person resides who has legal custody of the child (A.R.S. § 15-761).
Provisions
1. Redefines home school district as either:
a. the school district or charter school that the child last attended; or
b. the school district in which the person resides who has legal custody of child if the child has not previously attended a public school in this state.
2. Makes technical changes.
