SB 1258: class M driver licenses; applicability

History

A person is prohibited from driving a motor vehicle or vehicle combination on a highway without a valid driver license or endorsement, unless otherwise provided (A.R.S § 28-3151). Pursuant to A.R.S § 28-3101, a class M license is valid for operating the following: 1) a motorcycle; 2) motor driven cycle; or 3) moped. The Arizona Department of Transportation may also endorse a class M license classification on a valid Class A, B, C, D or G license. A class M license is not necessary for operating an autocycle.

Class D licensure is valid for operating a single motor vehicle with a gross vehicle weight rating of 26,000 pounds or less, including an autocycle.

 Autocycle is defined as a three-wheeled motorcycle on which the driver and passengers ride in a fully or partially enclosed seating area that is equipped with a roll cage, safety belts for each occupant and antilock brakes and that is designed to be controlled with a steering wheel and pedals (A.R.S § 28-101).

Provisions

1.       Excludes a motorcycle from class M licensure if it:

a.       Has at least three wheels;

b.       Has a three-point safety belt;

c.        Has bucket or bench seats; and

d.       Is fully enclosed or uses a roll cage frame. (Sec. 1)
