Adds reasons for which a public safety employee or volunteer may petition the court for an order authorizing testing of an individual for certain viruses or diseases.
History
A public safety employee or volunteer or the employing agency, officer or entity may petition the court for an order authorizing testing of another individual for the human immunodeficiency virus, common blood-borne diseases or other diseases specified in the petition if:
a. There are reasonable grounds to believe an exposure occurred; and
b. The individual bit, scratched, spat or transferred blood or other bodily fluids to the employee or volunteer while the employee or volunteer was performing official duties and any of the following apply:
i. The individual is charged with a criminal complaint that alleges that these actions occurred;
ii. There is probable cause to believe that the individual, whether living or deceased, performed these actions; or
iii. The individual is arrested, charged or in custody and the public safety employee or volunteer alleges, by affidavit, that the individual performed these actions (A.R.S. § 13-1210).
Provisions
1. Allows a public safety employee or volunteer to petition the court for an order authorizing testing of another individual for certain viruses and diseases if the public safety employee or volunteer, as a part of official duties, was exposed to blood or other bodily fluids while rendering aid to an individual, whether living or deceased, as a result of a medical emergency.
