Overview

Grants an operator of an electric standup scooter the same rights, privileges and duties of a person riding a bicycle.

History

Title 28, Chapter 3, Article 11 outlines requirements relating to the operation of a bicycle. When a person is riding a bicycle on a roadway or shoulder adjoining a roadway, the person is granted all the rights and is subject to all the duties applicable to the driver of a vehicle (A.R.S. § 28-812).

Pursuant to A.R.S. § 28-819, an operator of an electric bicycle is granted all the rights, privileges and duties of a person riding a bicycle. An electric bicycle is not subject to certificate of title, registration, vehicle license tax (VLT), driver licenses or vehicle insurance. Specified electric bicycle classifications may be used on a bicycle or multiuse path unless prohibited by a local authority.

Provisions

1.       States that an operator of an electric standup scooter is granted all the rights and privileges and subject to all the duties of a person riding a bicycle. (Sec. 6)

2.       States that an electric standup scooter is subject to the same statutory requirements and local regulations as a bicycle. (Sec. 6)

3.       Exempts an electric standup scooter from requirements relating to certificate of title, registration, VLT, driver licenses or vehicle insurance. (Sec. 6)

4.       Allows an electric standup scooter to be used on bicycle and multiuse paths, unless prohibited by a local authority. (Sec. 6)

5.       Requires an electric standup scooter to have a unique identification that:

a.       consists of letters, numbers or both;

b.       is visible from a distance of at least five feet;

c.        is not obscured by branding or other markings; and

d.       is used in identifying the scooter, applicable to all persons and local authorities. (Sec. 6)

6.       Specifies that a local authority is not prohibited from regulating electric bicycles and electric standup scooters. (Sec. 4-5)

7.       Allows a local authority to consider the environmental and traffic benefits of electric bicycles and electric standup scooters when imposing regulations. (Sec. 4-5)

8.       Specifies that a motorized skateboard does not have handlebars. (Sec. 1-5)

9.       Defines electric standup scooter and electric miniature scooter. (Sec. 1-3)
