Transfers specified sovereign land from the State to the City of Bullhead City and outlines requirements for land use, revenues and reversion.
History
Public trust land, or sovereign land, is the land in the bed of rivers that were navigable at the time of Arizona's statehood. This land is held in trust and is required to be used only for public trust purposes, which is defined in statute as commerce, navigation and fishing (A.R.S. § 37-1101). The Colorado River is the only navigable river in Arizona (Arizona State Land Department).
The State Land Commissioner is required to act as an advocate for public trust land and act diligently to promote the interests of the trust (A.R.S. § 37-1102).
Provisions
Land Transfer (Sec. 1)
1. Transfers the highlighted parcels of sovereign land (Transferred Land) from the State to Bullhead City:
2. Requires the State Land Commissioner to deliver a signed and recorded deed or patent containing the conditions on the use of the Transferred Land to Bullhead City within 10 days.
3. Requires the Transferred Land to be held and managed exclusively for public trust purposes, including public recreation and access to and enjoyment of the Colorado River.
4. Prohibits the Transferred Land from being sold, exchanged or bartered.
Revenues (Sec. 1)
5. Allows Bullhead City to charge a reasonable fee for costs to manage the Transferred Land.
6. Requires any revenue derived from the use of the Transferred Land to be deposited into an account to use solely for public trust purposes, including management of the Transferred Land.
Land Reversion (Sec. 1)
7. Reverts the Transferred Land back to the State immediately and automatically if the land or monies generated from the land cease to be held and managed exclusively for public trust purposes.
8. Allows a reversion to be confirmed through judicial proceedings.
