Summary of the Strike-Everything Amendment to SB 1464

Overview

History

Pursuant to A.R.S. § 5-108, The Department is required to conduct a thorough investigation concerning an application for a permit or a license.  In addition, statute grants the Department and the Commission discretion in refusing to issue or renew a license or permit and outlines the grounds for such a refusal. 

Further, if there is substantial evidence to conclude that an applicant has been convicted of a felony or any crime involving moral turpitude within the last five years, the Department or the Commission must refuse to issue or renew a license or approve a permit. According to the Department of Justice, administrative case law characterizes moral turpitude as "a nebulous concept, which refers generally to conduct that shocks the public conscience." Examples include, voluntary manslaughter, kidnaping, robbery, and aggravated assaults. 

Provisions

1.       Allows, rather than requires, the Department or the Commission to refuse to issue or renew a license or approve a permit for an applicant that has been convicted of a felony or any crime involving moral turpitude within the last five years. (Sec.1)
