Summary of the Strike-Everything Amendment to SB 1464
Overview
Allows the Department of Gaming (Department) or the Arizona Racing Commission (Commission) to refuse to issue or approve a license or permit based on certain convictions.
History
Pursuant to A.R.S. § 5-108, the Department is required to conduct a thorough investigation concerning an application for a permit or a license. In addition, statute grants the Department or the Commission discretion in refusing to issue or renew a license or approve a permit and outlines the criteria for such a refusal.
Specifically, the Department or the Commission may refuse to issue or renew a license or approve or renew a permit if there is substantial evidence to conclude that an individual has been convicted of a felony or any crime involving moral turpitude. Further, if an applicant has been convicted of a felony or any crime involving moral turpitude within the last five years, the Department or the Commission must refuse to issue or renew a license or approve a permit.
The term moral turpitude describes conduct which is "depraved and inherently base" or refers to "acts that adversely reflect on one's honesty, integrity, or personal values." (Frederickson v. Maricopa Cty. Sup. Ct., 187 Ariz. 273, 274 (Ct. App. 1996))
Provisions
1. Allows, rather than requires, the Department or the Commission to refuse to issue or renew a license or approve a permit for an applicant that has been convicted of a felony or any crime involving moral turpitude within the last five years. (Sec. 1)
