Outlines requirements for the Pest
Management Division Council and the Department of Agriculture Advisory Council
(Advisory Council).
History
The Advisory Council, regulated by the Arizona Department of Agriculture (ADA), is a five-member, governor-appointed body that reviews agricultural policy and assists the Director of ADA (Director) in formulating administrative rules and the ADA's budget (A.R.S. § 3-104).
The Director is permitted to appoint a division council within any division of the ADA. Division councils consist of representatives from various industries and commodities regulated by that division. Any organization may request representation on a division council, but actual appointments to the division council are at the discretion of the Director (A.R.S. § 3-105).
The Pest Management Division licenses, educates and regulates the pest management industry. The Pest Management Division Council was statutorily established to assist and make recommendations to the Director on the administration and implementation of pest management (A.R.S. § 3-3605).
Provisions
1. Requires the Pest Management Division Council to:
a. Annually elect a chairman and vice chairman among its members;
b. Meet at least once each quarter, at the call of the chairman, and if requested by at least three council members; and
c. Keep a permanent record of proceedings and make records available for public inspection. (Sec. 2)
2. Requires the Pest Management Division Council to advise the Director and Associate Director regarding:
a. Reviewing all proposed modifications or repeals of rules relating to pest management;
b. Amendments to pest management statutes;
c. The development of budgets and fees necessary for pest management procedures and services; and
d. Any other appropriate recommendations or assistance. (Sec. 2)
3. Requires the Advisory Council, before a meeting, to notify any division council of agenda items that may impact that division or industry. (Sec. 1,2)
4. Allows the Pest Management Division Council to make recommendations to the Advisory Council on agenda items that impact pest management. (Sec. 2)
5. Makes technical and conforming changes. (Sec. 1,2)
